Terms of Service

These Terms of Service govern your access to and use of the Australian Christian Business Awards website, portal, directory, nomination system, ticketing links, sponsorship forms, and related services (together, the Platform).

Effective date: April 20, 2026

Interpretation and acceptance

In these Terms, "ACBA," "we," "our," and "us" means Australian Christian Business Awards. "You" and "your" means any person or organisation accessing or using the Platform, including nominees, nominators, sponsors, ticket purchasers, directory members, judges, partners, and general website visitors.

By accessing or using the Platform, you agree to be bound by these Terms. If you use the Platform on behalf of a business, ministry, charity, or other organisation, you confirm that you have authority to bind that entity to these Terms.

1. Purpose of the Platform

The Platform exists to support the Australian Christian Business Awards and related initiatives, including recognition of Christian business leaders, community participation, nominations, event promotion, sponsorship opportunities, business directory participation, and other faith-centred marketplace programs.

We may offer both free and paid features through the Platform, including public website content, application or nomination forms, account registration, event ticket links, sponsor submissions, member listings, and promotional opportunities.

1A. Faith-based Platform

ACBA is a faith-based platform that exists to honour and celebrate Christian values expressed through business, leadership, and community impact.

While we seek to feature individuals and organisations who align with these values, inclusion on the Platform does not constitute certification, verification, or ongoing monitoring of faith practice, conduct, or business operations.

2. Eligibility

You must be at least 18 years old, or otherwise legally capable of entering into a binding agreement, to use the Platform.

You agree that any information you provide to us will be accurate, current, and complete. You must not submit false, misleading, or deceptive information, whether in connection with a nomination, profile, sponsorship enquiry, ticket purchase, directory listing, or account registration.

3. Accounts and Portal Access

Some parts of the Platform may require you to create an account or access a portal. Where you create an account:

  1. you are responsible for maintaining the confidentiality of your login details;
  2. you are responsible for activity conducted through your account;
  3. you must promptly update any inaccurate or outdated information; and
  4. you must notify us if you become aware of any unauthorised access or security issue relating to your account.

We may suspend or disable accounts where we reasonably believe there has been a breach of these Terms, misuse of the Platform, or conduct that may harm ACBA, its participants, or the wider community.

4. Nominations, Applications, and Submissions

If you submit a nomination, application, testimonial, business profile, sponsor enquiry, or other material through the Platform, you are responsible for ensuring that:

  1. the information is truthful, accurate, and not misleading;
  2. you have the right to provide that information;
  3. the content does not infringe any third-party rights, including privacy, confidentiality, copyright, trade mark, or reputation; and
  4. the content complies with all applicable laws.

Submission of a nomination, application, or other form does not guarantee selection, approval, publication, shortlisting, sponsorship acceptance, directory inclusion, event participation, or receipt of any award.

We may, in our discretion, review, verify, decline, edit for formatting, request further information about, or remove any submission.

5. Directory Listings and Public Profiles

Where the Platform includes a business directory or public profile feature, you acknowledge that information you submit for listing may be displayed publicly. This may include business name, contact details, website, location, logo, description, social links, category information, and other profile content you choose to provide.

You are solely responsible for deciding what information you submit for public display. You must not include confidential, private, or sensitive information in fields intended for publication.

We may refuse, suspend, unpublish, edit, or remove a listing at any time where we consider it incomplete, misleading, unlawful, inconsistent with our standards, or otherwise unsuitable for the Platform.

6. Tickets, Sponsorships, Paid Features, and Billing

The Platform may promote or link to paid products or services, including event tickets, sponsorship packages, memberships, premium listings, or related offers.

If you purchase or register for a paid feature:

  1. you agree to pay all applicable fees, charges, and taxes;
  2. you authorise us and any payment provider we use to process payment;
  3. you acknowledge that pricing, inclusions, and availability may change from time to time for future purchases; and
  4. you agree to any additional terms presented to you at checkout or in connection with the relevant offer.

Unless otherwise stated, fees paid are non-refundable except as required by applicable law, including any non-excludable rights under the Australian Consumer Law.

Where recurring subscriptions or memberships are offered, you remain responsible for cancelling before the next billing cycle if you do not wish to renew.

7. Event Participation

Where the Platform relates to an awards event, gala, conference, or similar gathering, you acknowledge that event details may change, including date, time, speakers, venue, format, or program content.

We may cancel, postpone, reschedule, relocate, or modify an event where reasonably necessary, including for operational, safety, legal, or circumstances beyond our control. Any refund, transfer, or credit rights will be handled in accordance with the terms applying to the relevant ticket, package, or applicable law.

You agree to conduct yourself respectfully at any ACBA event or related gathering. We may refuse entry or remove any person whose behaviour is unlawful, abusive, unsafe, disruptive, or inconsistent with the values or integrity of the event.

8. Use of Content and Licence to ACBA

You retain ownership of the content you submit to us. However, by submitting any content through the Platform, including names, biographies, testimonials, images, logos, nomination details, listing content, or promotional materials, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, host, store, reproduce, publish, adapt for formatting, display, distribute, and communicate that content for purposes connected with operating, promoting, administering, and improving ACBA and its programs.

This licence includes use in connection with:

  1. award administration;
  2. public profiles, nominee pages, directory pages, and winner announcements;
  3. event promotion and community engagement;
  4. social media, email, and website publication; and
  5. archival and record-keeping purposes.

You represent that you have obtained any necessary permissions from individuals whose personal information, image, or materials you submit.

9. Intellectual Property

All intellectual property rights in the Platform, including its branding, logos, design, text, graphics, software, layout, and underlying content, are owned by ACBA or its licensors unless otherwise stated.

You must not copy, reproduce, distribute, modify, republish, frame, reverse engineer, or exploit any part of the Platform without our prior written consent, except as permitted by law or these Terms.

Nothing in these Terms transfers ownership of our intellectual property to you.

10. Acceptable Use

You must not use the Platform in any way that:

  1. breaches any law or regulation;
  2. is false, misleading, defamatory, abusive, offensive, or discriminatory;
  3. infringes the rights of any person;
  4. interferes with the security, integrity, or performance of the Platform;
  5. attempts to gain unauthorised access to data, accounts, or systems;
  6. introduces malware, malicious code, or harmful material;
  7. scrapes, harvests, or bulk extracts content or directory data without our written consent; or
  8. harms, or is reasonably likely to harm, ACBA, its mission, its participants, or its reputation.

11. Third-Party Services and Links

The Platform may contain links to third-party websites, portals, ticketing providers, payment processors, partner organisations, social media platforms, and other external services.

We do not control third-party services and are not responsible for their content, security, availability, policies, or performance. Your use of third-party websites or services is at your own risk and may be subject to separate terms and privacy policies.

12. No Endorsement

Inclusion of a nominee, speaker, sponsor, judge, directory business, partner, or other participant on the Platform does not automatically constitute a guarantee, endorsement, accreditation, or recommendation by ACBA unless expressly stated.

We may celebrate and promote individuals and organisations aligned with the purpose of the Platform, but users remain responsible for making their own enquiries before relying on any listing, profile, representation, or service.

We make reasonable efforts to feature individuals and organisations aligned with Christian values; however, we do not guarantee, verify, or warrant the conduct, integrity, or performance of any participant or listed entity.

13. Privacy and Data Protection

We collect, use, and store personal information in accordance with our Privacy Policy.

ACBA is committed to protecting your personal information with integrity and care. We do not sell, rent, or share your personal information with third parties for marketing or solicitation purposes.

Your information is used solely for purposes connected to:

  • Awards administration
  • Event communication
  • Directory participation (where applicable)
  • ACBA-related updates and engagement

We take reasonable steps to protect your information from unauthorised access, misuse, or disclosure.

However, you acknowledge that no online platform can be completely secure, and you provide information at your own risk.

13A. Scams, Fraud, and Unauthorised Communications

ACBA does not sell, distribute, or provide your personal information to third parties for unsolicited marketing, sales, or external promotions.

We do not authorise any third party to contact participants, nominees, sponsors, or users of the Platform for independent commercial offers.

If you receive any communication claiming to be associated with ACBA that:

  • requests payment outside official ACBA channels;
  • offers unofficial partnerships, listings, or promotions;
  • appears suspicious or inconsistent with our communications.

you should treat it with caution and verify directly with us.

ACBA is not responsible for any loss, damage, or harm arising from scams, fraudulent activity, or unauthorised third parties falsely representing an association with ACBA.

14. Disclaimers

To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis.

We do not guarantee that:

  1. the Platform will be uninterrupted, secure, or error-free;
  2. any nomination, application, listing, or submission will be accepted or published;
  3. any event, program, or feature will continue to be available;
  4. any listing, profile, or public information will be complete, current, or accurate at all times; or
  5. use of the Platform will produce any business, promotional, ministry, or commercial result.

15. Limitation of Liability

To the fullest extent permitted by law, ACBA will not be liable for any indirect, incidental, special, exemplary, or consequential loss, or any loss of profits, revenue, goodwill, opportunity, data, or business arising out of or in connection with your use of, or inability to use, the Platform.

Where liability cannot lawfully be excluded, our liability is limited to the minimum extent permitted by law. Where applicable, our total aggregate liability in connection with a claim relating to paid services is limited to the amount paid by you to us for the relevant service in the 12 months before the claim arose, or AUD 100, whichever is greater.

Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded under applicable law, including the Australian Consumer Law.

16. Suspension, Removal, and Termination

We may suspend, restrict, remove, or terminate access to the Platform, any account, listing, submission, or related service at any time where we reasonably consider that:

  1. you have breached these Terms;
  2. you have provided false or misleading information;
  3. your conduct creates legal, reputational, operational, or safety risk;
  4. fees remain unpaid; or
  5. continued access is no longer appropriate for the operation or integrity of the Platform.

You may stop using the Platform at any time.

Any provision of these Terms which by its nature should survive termination will continue to apply, including provisions relating to intellectual property, licences, disclaimers, liability, payments already due, and dispute resolution.

17. Changes to These Terms

We may amend these Terms from time to time. Any updated version will be published on the Platform with a revised effective date. Your continued use of the Platform after updated Terms take effect constitutes acceptance of those updated Terms.

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia, unless another law applies on a mandatory basis. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from them.
